Welcome to einvitationmaker.com ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, mobile application, and SMS messaging services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
E-invitationmaker is an RSVP and e-invitation platform that lets users ("Hosts") create, send, and track event invitations, including via SMS text message.
1. Use of Service
- You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have the consent of a parent or legal guardian.
- You are responsible for all activity under your account.
- Invitations and content shared are your responsibility; do not upload unlawful, harmful, or infringing content.
2. Accounts
- You must provide accurate and current information.
- You are responsible for keeping your login credentials secure and for all activity on your account.
- You must notify us immediately of any unauthorized use of your account.
3. Invitations & RSVP Features
- We provide tools to create, send, and track event invitations by email and SMS text message.
- When importing contacts (e.g., via Google) or uploading guest lists, you represent and warrant that you have the right and the prior express permission of each recipient to send them invitations and related event communications from the Service, including by SMS where a mobile number is provided.
- You are solely responsible for the accuracy of the recipient data you upload and for compliance with applicable laws regarding the sending of messages, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any applicable state or international equivalents.
4. SMS Program Terms
By using the SMS features of the Service, you agree to the following:
- Consent: You agree that E-invitationmaker may send SMS messages to the mobile number associated with your account, and that we may send SMS messages to guests whose numbers are provided by a Host who has represented to us that they have permission to contact those guests.
- Message Types: Messages include event invitations, RSVP confirmations, event reminders, Host-initiated event updates, and account or support notifications.
- Message Frequency: Frequency varies based on event activity.
- Message & Data Rates: Message and data rates may apply depending on your mobile carrier and plan.
- Opt-Out: Reply STOP to any message to opt out of further SMS messages. Reply HELP for help, or contact info@einvitationmaker.com.
- Carriers: Wireless carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
- Host Responsibility: Hosts are solely responsible for the accuracy of recipient numbers and for obtaining the consent required by law to send messages to those recipients. You agree to indemnify and hold harmless E-invitationmaker for any claims arising from your failure to obtain such consent.
5. Payments (if applicable)
- Pricing for premium features or templates will be displayed before purchase.
- All payments are final unless required by law or expressly stated otherwise.
6. Prohibited Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or messages to recipients from whom you have not obtained appropriate consent.
- Send messages containing content related to sex, hate, alcohol, firearms, or tobacco (so-called "SHAFT" content), or any content that is unlawful, harassing, defamatory, deceptive, or otherwise objectionable.
- Violate intellectual property rights or the privacy or publicity rights of any person.
- Upload purchased, rented, or scraped contact lists.
- Use the Service to promote third-party products or services unrelated to your own event invitation.
- Attempt to disrupt, overload, or reverse-engineer the Service, or bypass any security or rate-limiting mechanism.
- Impersonate any person or misrepresent your affiliation with any person or entity.
7. Intellectual Property
All rights in our software, brand, logos, and Service content remain with E-invitationmaker. You retain rights to the content you upload, but you grant us a limited license to host, display, transmit, and process that content solely for the purpose of providing the Service to you.
8. Termination
We may suspend or terminate accounts that violate these Terms, applicable law, or the acceptable-use policies of our messaging providers or wireless carriers. You may terminate your account at any time by contacting us.
9. Disclaimers & Liability
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that any SMS or email message will be delivered to any particular recipient, as delivery depends on carriers and third parties outside our control.
- To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service.
10. Indemnification
You agree to indemnify, defend, and hold harmless E-invitationmaker and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, including recipients of messages you cause to be sent through the Service.
11. Changes to Terms
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms. Material changes will be communicated through the Service or by email where appropriate.
